Terms of Use

1. Who We Are and Acceptance

These Terms of Use ("Terms") govern access to and use of the website https://guifw.com and the online software guiFW – Filament Winding, including the registration of machines, mandrels, payout eyes and materials and the generation of CNC programs (together, the "Service"). The Service is operated by Inventhors Indústria e Comércio de Máquinas Industriais Ltda., CNPJ 51.537.902/0001-00 ("guiFW", "we", "us" or "our"), a Brazilian company that designs and builds filament winding machines.

These Terms describe what we commit to do for you and what we expect from you. By creating an account, subscribing to a plan or using the Service, you accept these Terms and our Privacy Policy. If you use the Service on behalf of a company, you confirm that you are authorized to represent it.

2. Our Commitments to You

We commit to:

  1. Keep the Service running. We monitor the Service and address failures as soon as we become aware of them.
  2. Fix errors as a priority. Any error you report in trajectory calculation or program generation gets top priority. Once confirmed, we will fix it at no cost and notify the users who may have been affected.
  3. Give notice before maintenance. Scheduled maintenance that makes the Service unavailable will be announced in advance and, whenever possible, carried out outside business hours.
  4. Protect your data. We keep regular backups, encrypted connections (HTTPS) and access restricted to the staff who need it.
  5. Keep your projects confidential. Your machine, mandrel, material and program data are confidential. We do not sell them, share them with other customers or competitors, or use them in third-party projects. We only access your projects to provide support with your permission or when required by law.
  6. Be transparent about incidents. If a security incident affects your data, we will notify you and the competent authorities, as required by the LGPD.
  7. Make sure your data stays yours. You can export your data and programs at any time. There is no lock-in period and no cancellation fee.
  8. Keep the agreed price. Your plan price does not change mid-cycle. Any price change will be announced at least 30 days in advance.
  9. Answer support requests. On plans that include support, we reply to email messages within 2 business days.
  10. Not take away what you paid for. We will not reduce the features of a paid plan without prior notice. If that happens, you may cancel and receive a pro-rata refund for the unused period.
  11. Listen to you. We consider user suggestions as guiFW evolves and keep you informed of relevant news and changes.

3. User Account

  • You must be at least 18 years old and provide true, up-to-date information.
  • Keep your password confidential. You are responsible for activity carried out in your account.
  • If you suspect unauthorized access, let us know at guifw@guifw.com. We will help you secure the account.

4. Plans, Subscription and Payment

  • The Service has a Free plan at no cost and paid plans (Starter, Professional and Industry). Prices, limits, features and plan-change rules are described on the Plans and Limitations page, which is part of these Terms.
  • Paid plans are billed in advance, monthly or annually. PayPal subscriptions renew automatically until canceled; boleto and PIX charges are sent before each due date.
  • New accounts get the Professional plan free for 30 days, with no card required. Nothing is charged automatically: if you do not subscribe, the account moves to the Free plan at the end of the trial, without losing data.
  • Taxes are added where required by law.

5. Cancellation, Refunds and Credits

  • You can cancel at any time from your account or by email, with no fee. Access continues until the end of the period already paid.
  • Right of withdrawal: you may withdraw from your first subscription within 7 days and receive a full refund (art. 49 of the Brazilian Consumer Defense Code).
  • Annual plans: if you cancel after the 7-day withdrawal period, we refund the full months not yet used; access continues until the end of the month in progress.
  • Downtime credit: if the Service is unavailable due to our fault for more than 24 consecutive hours, you will receive, on request, a credit on your next invoice proportional to the downtime.
  • Your data after cancellation: it is kept for at least 90 days so you can export it or reactivate your account. After that, it is deleted or anonymized, unless the law requires us to keep it.

6. License to Use

We grant you a limited, non-exclusive, non-transferable license to use the Service while your account is active, according to your plan. To keep the Service fair and safe for everyone, you may not:

  • copy, modify, decompile or reverse engineer the software, except where permitted by law;
  • resell, sublicense or make the Service available to third parties;
  • share credentials to get around plan limits;
  • use automated means to overload the Service or extract data from it;
  • use the Service for unlawful purposes.

7. Your Data and the Programs You Generate

  • The data you enter and the CNC programs generated from it belong to you.
  • We use this data only to provide, maintain and improve the Service, as described in Section 2 and in the Privacy Policy.

8. Safe Operation: a Shared Responsibility

guiFW is an engineering tool built by people who design and run filament winding machines. The safety and quality of the result depend on both of us.

On our side, we develop and test the trajectory algorithms carefully, fix reported errors as a priority, and provide tutorials and support to guide correct use.

On your side, because programs are generated from the parameters you enter and run on your equipment, we ask you to:

  • check the parameters and validate each program before production, for example by simulation, a dry run or reduced speed;
  • check compatibility between machine, mandrel, material and program;
  • follow the applicable safety standards, such as Brazilian NR-12 and the manufacturer’s instructions, and have the machine operated only by qualified personnel;
  • confirm that the part meets your design requirements and any required certifications, especially in critical applications such as pressure vessels and structural or aerospace parts.

If you have any doubt about a result, talk to us before producing. We will be glad to help.

9. User Content

In the forum, blog and chat, each user is responsible for what they post. Unlawful or offensive content, or content that infringes third-party rights, is not allowed. We may remove content that breaches these Terms. By posting in public areas, you allow us to display that content on the Service.

10. Intellectual Property

The guiFW software, brand, website, tutorials and other materials belong to Inventhors and are protected by Brazilian Laws No. 9.609/1998, 9.610/1998 and 9.279/1996. These rights are not transferred to you. Your data and programs remain yours, as stated in Section 7.

11. Limits of Liability

We take on the responsibilities described in Section 2. To the fullest extent permitted by law, we are not liable for:

  • damage caused by programs used without the validation described in Section 8, or by incorrect parameters entered by the user;
  • loss of profits, loss of production or indirect damages;
  • third-party failures beyond our control, such as the user’s internet connection, power outages and force majeure.

Our total liability is limited to the amount you paid us in the 12 months before the event. This clause does not limit the rights guaranteed to consumers by the Brazilian Consumer Defense Code, nor our liability for wilful misconduct or gross negligence.

12. Suspension and Termination

We will only suspend an account for breach of these Terms, non-payment or a risk to the security of the Service. Except in urgent situations, we will notify you first and give you time to resolve the issue. Even if your account is suspended, you can still export your data within the period in Section 5.

13. Third-Party Links

The Service may contain links to third-party websites that we do not control. We are not responsible for their content or practices.

14. Changes to These Terms

Significant changes will be announced on the website and by email at least 30 days in advance, explaining what changed. If you do not agree, you may cancel at no cost before the changes take effect.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Brazil. If any clause is held invalid, the others remain in effect. The courts of São José dos Campos/SP, Brazil have jurisdiction; consumers may bring proceedings in the courts of their own domicile. Before any legal action, we will try to resolve the matter amicably through the email below.
